1. Agreement to Terms

By accessing and using the Champ Army service (the "Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users of the Service, including but not limited to users who are contributors of content, information, and other materials or services on the Service.

2. Service Description

Champ Army provides a Software-as-a-Service (SaaS) platform that enables users to deploy and manage AI-powered expert agents. The Service includes access to our web application, API, and related features as described on our website.

3. Account Registration and Responsibility

To use the Service, you must create an account and provide accurate, complete, and current information. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Complying with all applicable laws and regulations

4. Acceptable Use Policy

You agree not to use the Service for:

  • Any illegal or unauthorized purpose
  • Violating any laws or regulations in your jurisdiction
  • Harassing, abusing, or threatening others
  • Transmitting malware, viruses, or harmful code
  • Attempting to gain unauthorized access to the Service or other systems
  • Reverse engineering, decompiling, or attempting to derive the source code of the Service
  • Removing or obscuring any proprietary notices or labels

5. Intellectual Property Rights

The Service and all content, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio) are owned by Champ Army, its licensors, or other providers of such material and are protected by copyright, trademark, and other intellectual property laws.

You retain all rights to any content you upload or create within the Service. By uploading content, you grant Champ Army a worldwide, non-exclusive, royalty-free license to use, copy, modify, and display such content for the purpose of providing the Service.

6. Subscription and Billing

Your subscription to the Service is subject to the following terms:

  • Billing occurs on a monthly or annual basis as selected during signup
  • Charges are billed to your payment method on file
  • You are responsible for providing accurate billing information
  • Subscription automatically renews unless cancelled before the renewal date
  • Refunds are not provided for partial months or unused portions of your subscription
  • We reserve the right to change pricing with 30 days' notice

7. Cancellation and Termination

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • Your access to the Service will end at the end of your current billing period
  • No refunds will be issued for the current billing period
  • Your data will be retained for 30 days before permanent deletion

Champ Army may terminate or suspend your account immediately if you violate these Terms or engage in prohibited conduct.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We collect and process data as described in our Privacy Policy. You are responsible for ensuring you have the right to share any data you upload to the Service and that such data complies with all applicable laws.

9. Warranties Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CHAMP ARMY MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SERVICE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. CHAMP ARMY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHAMP ARMY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL CHAMP ARMY'S TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless Champ Army and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Service Level and Availability

Champ Army strives to maintain high availability of the Service. However, we do not guarantee uninterrupted service. We may perform maintenance, updates, or other activities that may temporarily interrupt service. We will make reasonable efforts to provide advance notice of planned downtime.

13. Third-Party Services

The Service may integrate with or depend on third-party services. Champ Army is not responsible for the availability, accuracy, or functionality of third-party services. Your use of third-party services is subject to their respective terms and conditions.

14. Changes to Terms

Champ Army reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting to the website. Your continued use of the Service following the posting of revised Terms means that you accept and agree to the changes.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts located in the Netherlands.
